С 13 августа в Федеральном законе от 13 июля 2015 г. № 218-ФЗ «О государственной регистрации недвижимости» (далее – Закон № 218-ФЗ) действует норма, предусматривающая внесение в ЕГРН записи о возможности представления в случае отчуждения соответствующего объекта недвижимости заявления о госрегистрации перехода, прекращения права собственности на объект недвижимости и прилагаемых к нему документов в форме электронных документов или электронных образов документов, подписанных усиленной квалифицированной электронной подписью. Соответствующая отметка проставляется в реестре на основании поступившего от правообладателя недвижимости заявления (ст. 36.2 Закона № 218-ФЗ).
При этом начиная с 1 ноября текущего года орган регистрации прав в день поступления заявления о госрегистрации перехода, прекращения права собственности на объект недвижимости, принадлежащий физлицу, и прилагаемых к нему документов в форме электронных документов или электронных образов документов, подписанных усиленной квалифицированной электронной подписью, уведомляет собственника недвижимости о таком заявлении (ч. 5 ст. 36.2 Закона № 218-ФЗ). Как ранее подчеркивали эксперты, эта норма действует независимо от наличия отметки в ЕГРН о возможности регистрации на основании документов, подписанных усиленной квалифицированной электронной подписью. Для реализации возможности уведомления Росреестр призывает правообладателей актуализировать свои контактные данные в ЕГРН (сообщения об этом содержатся на официальных сайтах федеральной службы и ее региональных управлений).
Алгоритм действий правообладателя недвижимости по актуализации своих контактных данных в ЕГРН достаточно прост. Для этого потребуется:
обратиться в любой МФЦ (независимо от места жительства собственника и места регистрации недвижимости), при себе необходимо иметь паспорт;попросить бланк заявления «Об исправлении технической ошибки в записях ЕГРН, о внесении сведений в ЕГРН заинтересованным лицом, о внесении в ЕГРН записей о наличии возражения в отношении зарегистрированного права на объект недвижимости, записей о невозможности государственной регистрации права без личного участия правообладателя, записей о наличии прав требований в отношении зарегистрированного права, отдельных записей о правообладателе, а также отдельных дополнительных сведений об объекте недвижимости»;заполнить соответствующую строку п. 3.1.3 указанной формы в зависимости от того, какую информацию нужно включить или изменить в ЕГРН (для указания адреса электронной почты или почтового адреса – строку «об адресе электронной почты и (или) о почтовом адресе лица, чье право на объект недвижимости зарегистрировано, а также лица, в пользу которого зарегистрировано ограничение права и обременение объекта недвижимости», а для отражения актуального номера телефона – строку «иные предусмотренные законодательством Российской Федерации сведения»).
Изменения будут внесены регистрирующим органом бесплатно в течение трех рабочих дней со дня подачи заявления.
Руководитель Управления Росреестра по Москве Игорь Майданов отмечает, что, поскольку вся информация об объектах недвижимости и ее собственниках, в том числе контактные данные, вносятся в реестр на основе представленных заявлений, многие сведения уже устарели – особенно, если заявления были поданы много лет назад. Кроме того, в комментарии порталу ГАРАНТ.РУ он пояснил, что в случае если у одного объекта недвижимости имеется несколько собственников, то каждый из них должен обновить свои данные.
Отметим, наличие в ЕГРН почтового адреса, номера телефона или адреса электронной почты позволит в случае необходимости своевременно связаться с собственником и предотвратить возможные неправомерные действия третьих лиц в отношении недвижимости, правообладателем которой он является. Это касается, например, регистрации договора купли-продажи жилья, исправления технической или реестровой ошибки, продажи доли в общедолевой собственности, проведения межевания соседнего участка и т. д.
