Подписание соответствующего закона Президент РФ Владимир Путин анонсировал в ходе традиционной «Прямой линии». Речь идет о внесении изменений в ст. 446 Гражданского процессуального кодекса и Федеральный закон от 2 октября 2007 г. № 229-ФЗ «Об исполнительном производстве» (Федеральный закон от 29 июня 2021 г. № 234-ФЗ).
Согласно поправкам у россиян появится право на обращение в подразделение судебных приставов, в котором возбуждено или уже ведется исполнительное производство, с заявлением о сохранении зарплаты и иных доходов ежемесячно в размере прожиточного минимума трудоспособного населения в целом по России при обращении взыскания на его доходы. Соответствующая сумма будет считаться неприкосновенным минимальным размером дохода, необходимым для существования должника-гражданина и лиц, находящихся на его иждивении.
Для реализации этого права в службу судебных приставов нужно будет представить заявление и документы, подтверждающие наличие ежемесячного дохода, а также сведения об источниках такого дохода. В самом заявлении следует указать: Ф. И. О., гражданство, реквизиты документа, удостоверяющего личность, место жительства или место пребывания, номер контактного телефона; реквизиты открытого в банке или иной кредитной организации банковского счета, на котором необходимо сохранять зарплату и иные доходы ежемесячно в размере прожиточного минимума; наименование и адрес банка или иной кредитной организации, обслуживающей банковский счет, реквизиты которого указаны в заявлении.
При наличии в постановлении судебного пристава-исполнителя об обращении взыскания на денежные средства, находящиеся на счетах должника, требования о сохранении зарплаты и иных доходов в размере прожиточного минимума удержание денежных средств будет осуществляться с соблюдением этого требования – банк или иная кредитная организация не сможет обратить взыскание на эту неприкосновенную сумму. Однако ограничение размера удержания не будет применяться по исполнительным документам, содержащим требования о взыскании алиментов, о возмещении вреда, причиненного здоровью, о возмещении вреда в связи со смертью кормильца, о возмещении ущерба, причиненного преступлением.
Кроме того, при наличии лиц, находящихся на иждивении у должника-гражданина, должник сможет подать в суд заявление о сохранении зарплаты и иных доходов ежемесячно в размере, превышающем прожиточный минимум.
Также в законе появится оговорка, согласно которой если величина прожиточного минимума, установленного в регионе по месту жительства должника-гражданина для соответствующей социально-демографической группы населения, превышает величину прожиточного минимума трудоспособного населения в целом по России, то в качестве неприкосновенного минимального дохода можно будет заявить именно размер регионального прожиточного минимума.
Новые нормы начнут действовать с 1 февраля 2022 года. Президент РФ считает их важными, поскольку они направлены на повышение гарантий гражданам, попавшим в сложную жизненную ситуацию.
